进入21世纪以来,行政规划逐渐走上了我国行政法学研究的显学位置。然而控权理论下的行政法,对于具有广泛裁量性的行政规划缺少完善的规制体系。从侵害入手,通过对行政规划侵害的类型化和具体化研究,梳理行政规划可诉的理论基础具有重要意义。确定行政规划诉讼的受案范围,应以是否产生侵害,作为区分行政规划可诉与否的界限。以行政规划侵害类型化为视角,探究行政规划诉讼原告的撤销、损失补偿和损害赔偿请求权在各类行政规划诉讼中的配置,具有创新性探索价值。此外,公益诉讼制度的引进也是解决当前矛盾的重要措施之一。
Since entering the 21st century, administrative planning has gradually embarked on a significant position in the study of administrative law in our country. However, the administrative law under the control theory lacks a perfect regulatory system for administrative planning with a wide range of discretionary power. From the infringement, through the type of administrative planning violations and specific research, combing the theoretical basis of administrative planning may litigate is of great significance. Determining the scope of the case of administrative planning litigation, should be based on whether infringement, as the distinction between administrative litigation or not. In the perspective of administrative planning infringement type, this paper explores the disposition of the plaintiffs in administrative planning litigation, the disposition of claims for damages and damages in various administrative planning proceedings, and has an innovative exploration value. In addition, the introduction of public interest litigation system is also one of the important measures to solve the current contradictions.
