近 50年来 ,我国的个体私营经济及其立法经历了曲折的发展道路。从不允许独立存在到“拾遗补缺” ,再到成为社会主义初级阶段的基本经济制度和社会主义市场经济的重要组成部分。在加速发展个体私营经济的同时 ,面临着如何选择立法取向的问题。应摒弃按企业所有制性质分别立法的传统 ,着眼建立适应社会主义市场经济的法律体系
In the past 50 years, China’s individual and private economy and its legislation have experienced a tortuous path of development. Never allow the existence of independence to “pick up fill vacancies”, and then to become the basic economic system in the initial stage of socialism and an important part of the socialist market economy. While accelerating the development of individual and private economy, it is faced with the issue of how to choose the legislative direction. We should abandon the tradition of separate legislation on the basis of the nature of enterprise ownership and focus on establishing a legal system that can be adapted to the socialist market economy
