虽然家庭工人与其他劳动者相比,具有“劳动者”的一般性法律地位,然而,家庭工在工作性质、主体构成以及职业类型等方面区别于其他行业,因此呈现出“共同但有区别”的职业特征。在保护家庭工人劳动权利领域,国际劳工组织的《家庭工人体面劳动公约》创立了一种崭新的人权普遍性原则与劳动权利保护竞合的方法。其中,平等权、禁止性别歧视以及移徙权在家庭工人权利保障中发挥着重要的作用,这为我国制定家庭工人权益保障的专门性立法提供了以“权利基础”为导向的新理念。
