辩诉交易被认为是对抗式法律制度产物,学界曾对辩诉交易制度移植开展了激烈讨论。当时多数赞同暂缓移植或认为我国无其生存土壤。笔者试图通过美国辩诉交易与中国式辩诉交易的比较研究,寻找我国辩诉交易制度影踪。
Plea bargaining is considered to be the product of the adversarial legal system. The academic circles conducted heated discussions on the transplantation of plea bargaining system. Most agreed at the time to suspend the transplant or that our country had no place to live. The author attempts to find a way for the system of plea bargaining in our country through the comparative study of plea bargaining and Chinese plea bargaining.
