检察机关在查阅我所卫生行政处罚案卷过程中,对一起医师在执业活动中造成医疗责任事故,给予责令暂停六个月执业活动的处罚决定提出异议,认为应按医疗事故罪移交司法程序,否则可能构成渎职。笔者就卫生监督机构介入医疗事故处理执法实践,区分医疗事故罪与罚等问题进行探讨并加以总结,避免以罚代刑,以资同行们借鉴和参考。
