信访是具有中国特色的一项制度,对促进公民参与政治生活、加强对公权力的监督、实现私权救济具有重要作用。然而由于信访制度本身的缺陷,当前信访制度存在许多问题,成为阻碍法治进程的重要因素,信访制度改革也因此成为当前热点问题。对于信访及其问题的研究,关键在于对信访功能的认识和定位问题。通过了解信访制度的历史和现状,分析我国信访功能的嬗变,并对信访功能重新定位,从而完善信访制度。
Petition is a system with Chinese characteristics and plays an important role in promoting citizens’ participation in political life, strengthening the supervision of public power and realizing private remedies. However, due to the flaws of the petition system itself, there are many problems in the current system of petitioning and petitioning, which has become an important factor impeding the progress of the rule of law. Therefore, the reform of petition system has become the current hot issue. The key to the study of letters and visits and its problems lies in the cognition and orientation of the functions of letters and visits. By understanding the history and present situation of the petition system, this paper analyzes the evolution of the petition system in our country, and repositions the petition system so as to improve the petition system.
