当前,相对于城市居民而言,农民工在政治、经济和文化的许多领域都受到了差别、限制对待,其处境仍令人堪忧。目前,国内针对农民工权利保护问题在宪法层面上的研究并不多,宪法是一个国家的根本法,它保护着的是对公民有着深重影响的基本权利,如果不能在法的最高架构下加以保护,将会导致立法、执法等环节的失控。因此,对于农民工基本权利的保护,笔者认为应从源头入手,在最具权威性的宪法总框架下进行。
