对商品标识的保护是《反不正当竞争法》的一个重要内容,我国《反不正当竞争法》第5 条专门进行了规制。但是对《反不正当竞争法》保护的范围、力度以及与相关法规的关系仍存在着争论。本文在分析我国反不正当竞争法对注册商标与非注册商标的保护以及与商标法规制角度和力度的差异上,指出我国反不正当竞争法一方面弥补了传统法规对商品标识保护的不足,另一方面,又具有自己独特的保护角度和范围。在此基础上,本文也对我国反不正当竞争法对保护商品标识的不足进行了分析,以期对今后的立法有所裨益。
The protection of the trademark is an important part of the Anti-Unfair Competition Law. Article 5 of China’s Anti-Unfair Competition Law specifically regulates. However, there is still controversy over the scope and intensity of the “Unfair Competition Law” protection and its relationship with relevant laws and regulations. On the analysis of the differences between the Chinese anti-unfair competition laws on the protection of registered trademarks and non-registered trademarks and on the angle and intensity of the regulation on trademark law, this article points out that our country’s anti-unfair competition law makes up for the deficiency of traditional laws and regulations on the protection of commodity labels on the one hand, On the other hand, it also has its own unique protection perspective and scope. On this basis, this article also analyzes the shortcomings of China’s Anti-Unfair Competition Law on the protection of commodity identification in order to benefit the future legislation.
