在刑事诉讼中,量刑不仅关系到被告人的处罚结果,还关系到被害人的权利保障,更关系到司法公正。多年来,检察机关不断探索和推进量刑建议制度,对实现量刑公正,维护法律统一发挥了积极作用,但在实践中仍存在不少问题及困难,需要加以认真研究和解决,以促进量刑建议制度的完善。文章结合从化市人民检察院量刑建议工作开展的情况,对量刑建议工作过程中发现的问题加以分析,并提出完善量刑建议的方法,以期促进量刑工作更好发展。
In criminal proceedings, the sentencing not only concerns the result of the defendant’s punishment, but also relates to the protection of the victims’ rights and the judicial justice. Over the years, procuratorial organs have been constantly exploring and advancing the system of sentencing, which has played an active role in realizing justice of sentencing and safeguarding the unification of laws. However, there are still many problems and difficulties in practice, which need to be studied and resolved seriously in order to promote sentencing recommendations Perfect. Based on the implementation of the sentencing suggestion work of the People’s Procuratorate in Conghua City, the article analyzes the problems found in the sentencing suggestion work and puts forward the methods to improve the sentencing suggestion so as to promote the sentencing work to develop better.
