行政约谈制度的兴起在行政执法领域得到广泛的认可,其柔性的执法特点充分体现了行政软法化的新型行政模式,显示了建设服务型政府的内在诉求。文章认为行政约谈制度具有较充分的法理依据,其降低了行政执法的成本,体现了公益与私益、权力与义务的平衡,使得行政执法更加民主化,公法与私法在一定的领域得到了融合。
The rise of the administrative interview system has been widely recognized in the field of administrative law enforcement. Its flexible law enforcement features fully embody the new administrative mode of administrative soft law and show the intrinsic demands of building a service-oriented government. The article holds that the system of administrative interviews has more legal basis, which reduces the cost of administrative law enforcement, reflects the balance between public welfare and private benefits, power and obligations, makes the administrative law enforcement more democratic, public law and private law in a certain area has been integrated .
