当前的“农民、农村、农业”问题,已经不仅仅是一个法学问题,而是一个涉及到社会学、经济学等诸多学科的问题。虽然学术界针对“三农”问题提出了许多富有建设性的意见和建议,但是,笔者认为,从历史中寻找开启我国农地制度困境的钥匙,是一个富有创新性的视角。基于此,本文探讨了罗马法之永佃权制度、日尔曼法之马尔克公社土地所有权制度以及中国固有法之永佃制和一田二主制度。笔者认为,这些宝贵的历史素材对解决我国目前农村土地制度存在的问题具有重要的借鉴意义。
The current “peasants, rural areas and agriculture” issue has become more than just a legal issue, but an issue involving sociology and economics. Although many constructive comments and suggestions have been put forward on the “three rural issues” in academia, the author believes that it is an innovative perspective to find the key to opening up the predicament of China’s agricultural land system from history. Based on this, this article explores the system of the permanent tenant rights in Roman law, the land ownership of the Mark commune in the Germain Act and the tenancy system and the system of one country and two owners in China’s inherent law. The author believes that these precious historical materials have an important reference for solving the existing problems in China’s rural land system.
