医疗事故犯罪构成之客观方面,概指医护人员在医疗护理过程中违反规章制度,表现为严重不负责任,造成就诊人死亡或严重损害就诊人身体健康的行为。但是,医疗护理行为违反规章制度的界定标准不统一,不可否认,迟滞了医疗刑事犯罪的法治进程,基于此,医疗刑事犯罪之客观方面类型化有重要意义。
