随着社会主义法制建设的延伸,公民的法律意识逐渐增强,涉及到精神损害的国家赔偿问题日益增多。虽然国家的赔偿法出台时间较长,但在解决国家赔偿中仍然存在着诸多问题。因此,本文试从精神损害的国家赔偿状况分析入手,结合当前突出的问题,进而阐述国家赔偿中确立精神损害赔偿的必要与可行性,构建完善的国家赔偿制度,更好地保障人权,推进社会主义法制建设。
With the extension of the socialist legal system, citizens’ awareness of law has gradually increased, and state compensation involving mental damage has been increasing. Although the compensation law of the state has been issued for a long time, many problems still exist in resolving the state compensation. Therefore, this article tries to start from the analysis of state compensation for mental damage, combining with the current outstanding problems, then elaborates the necessity and feasibility of establishing mental damage compensation in state compensation, constructs a perfect national compensation system, better protects human rights and promotes the society Legal construction.
