新修订的《消费者权益保护法》对我国公益诉讼制度的发展完善具有深远意义,其不仅在一定程度上解决了有关消费者侵害公益诉讼主体资格的长期争论,也昭示了立法机关对公益诉讼的一种立法倾向——即通过在实体法中规定具体条款来弥补程序法中的制度缺失。由此及彼,可以想见我国的环境公益诉讼制度未来也必将在相关的实体法律中得到体现,有关诉讼主体资格、救济方式等等集中争议的问题也将会得到法律解答。立法机关这一高屋建瓴、循序渐进的立法模式令人赞叹,但另一方面,环境公益诉讼制度如何与实体法进行衔接才能达到体系化效果仍然是一个让人深思的问题。本文即从这一立意出发,探讨环境公益诉讼制度的实体法、部门法选择以及具体条款的设计,以期对我国的公益诉讼制度有所增益。
The newly revised Law on the Protection of Rights and Interests of Consumers has far-reaching significance for the development and improvement of the public interest litigation system in our country. It not only solves the long-standing controversy over the qualification of consumers for infringement of public interest litigation to a certain extent, but also shows that the legislative organs’ A legislative tendency - to make up for the lack of system in the procedural law by stipulating specific clauses in substantive law. From this and others, we can imagine that the environment litigation system in our country will also be reflected in the relevant substantive laws. The issues concerning the litigant qualification, remedies and so on will also be answered by law. However, on the other hand, it is still a pondering issue that how the environmental public interest litigation system can be linked with the substantive law to achieve the systemic effect. Based on this conception, this article explores the substantive law, the choice of sectoral law and the design of specific provisions of environmental public interest litigation system, with a view to gain some benefits for our country’s public interest litigation system.
