高校与学生之间是一种二元结构的法律关系,即平权的法律关系和隶属的法律关系,因此,高校学生管理应当坚持依法管理原则和权利至上理念,校纪校规的制定应坚持合法合理原则,还应坚持程序正当和有权利必有救济理念。高校行使管理权限时所担负的责任可分为民事法律责任和行政法律责任。
Therefore, the management of college students should adhere to the principle of law-based management and the supremacy of rights. The formulation of school rules and regulations should insist on lawful and reasonable Principle, we should also uphold the principle of due process and the right to have the concept of relief. The responsibilities of colleges and universities in exercising their administrative powers can be divided into civil legal liabilities and administrative legal liabilities.
