我国监护制度与古老的禁治产人制度存在着密切的继受关系。如今我国监护制度中存在的许多不足或可以从禁治产人制度中寻找到解决方案。本文简要介绍了禁治产人制度,并认为我国现行监护制度中存在着范围划分不合理、实施成本高、削弱人情等问题。作者试图探求禁治产人制度中的合理部分用以完善我国的监护制度。
The system of guardianship in our country has a close relationship with the ancient system of banning the birth of people. Many shortcomings in the guardianship system in our country nowadays may find a solution from the system of prohibition of abortion. This article briefly introduces the system of banning the birth of people and thinks that the current system of guardianship in our country has such problems as unreasonable scope of division, high implementation cost and weaken human condition. The author attempts to explore the reasonable part of the system of banning the birth of people to improve the guardianship system in our country.
