农村司法现代化缺失互动机制,现代司法制度在农村实施缺乏适宜的社会生态条件。中国农村司法现代化必须走社会演进与国家推动相结合的道路,要遵循司法现代化的生成规律,给农村地方性知识以多元、宽容的理解;重读农村传统司法文化,构建涵盖农村地方性司法资源的司法现代化;回归司法为民的目的型价值维度,明确农民在农村司法现代化进程中的主体地位。
There is a lack of interactive mechanism in the judicial modernization in rural areas and the lack of suitable social and ecological conditions for the implementation of modern judicial system in rural areas.
