进化的法律文明总是在突发的事件中得以改良与升华的。虽然美国的次级债风波已趋于平息,但它却在立法者及职业学者的心头留下了丝丝余悸与反思。这场危机不仅在检验美国的金融监管法律制度与理念,同时也拷问着国际金融合作机制的完善与否。在金融法构建中,美国法始终是我国参考、印证与模仿的对象。因此,美国的此次危机事实上也给我国提供了一个“青出于蓝而胜于蓝”的良机。
Evolutionary legal civilization is always improved and sublimated in unexpected events. Although the subprime crisis in the United States has tended to subside, it has left a flurry of frustrations and reflections on the minds of legislators and professional scholars. This crisis is not only testing the legal system and concept of financial supervision in the United States, but also interrogating the improvement of the international financial cooperation mechanism. In the construction of financial law, the law of the United States is always the target of our country’s reference, confirmation and imitation. Therefore, the crisis in the United States in fact also provides our country with a golden opportunity to “win beyond blue”.
