编制外用工队伍是高校后勤服务和校园安全的主要力量之一。《劳动合同法》实施后,很多高校为了减少用工风险把劳务派遣作为首选的编制外用工形式,采用劳动合同用工形式的高校却因诸多不公平地方政策、各种劳动纠纷案件而陷入进退两难境地。为回归《合同法》立法本意,保障劳动者合法权益,政府必须出台相关政策,严格规范劳务派遣,适当扶植劳动合同用工,维护社会和谐与稳定。
The preparation of the expatriate team is one of the major forces in the logistics services and campus safety in colleges and universities. After the implementation of the Labor Contract Law, many colleges and universities, in order to reduce labor risks, have made labor dispatch the preferred form of external employment. Colleges and universities employing labor contracts have been caught in a dilemma because of many unfair local policies and various labor disputes. In order to return to the legislative intent of the “Contract Law” and safeguard the legitimate rights and interests of workers, the government must promulgate relevant policies, strictly regulate labor dispatch, properly promote employment in labor contracts and safeguard social harmony and stability.
