法治的本质是程序之治,程序正义是现代法治国家的重要标志,是深化政治体制改革、建设社会主义法治国家的必然要求。从提出依法治国的基本方略至今,我国在程序法治建设上取得了巨大的成就,但由于没有经历过商品经济从低级到高级的自然发展的过程,人们也就没有自然地形成现代法治理念。本文从经济、政治、文化及社会四个方面出发,分析了当代中国程序正义缺乏的根源,并相应地提出了程序正义在中国的实现途径。
The essence of the rule of law is the rule of procedure, and procedural justice is an important symbol of the modern rule of law. It is an inevitable requirement for deepening the reform of the political system and building a socialist country ruled by law. Since the basic strategy of governing the country according to law, our country has made great achievements in the construction of the rule of law in our country. However, people have not naturally formed the concept of the modern rule of law without ever experiencing the natural development of the commodity economy from a lower level to a higher level. Based on four aspects of economy, politics, culture and society, this article analyzes the causes of the lack of procedural justice in contemporary China and puts forward corresponding approaches to the realization of procedural justice in China.
