案由合理开发利用地下空间资源对我国城市可持续发展至关重要。改革开放以来,我国城市建设中催生了大量规模化地下空间工程项目,而我国关于地下空间资源开发利用方面的立法尚处于探索阶段,在民事基础立法项上基本是空白,仅有《物权法》第136条规定略微涉及,这显然不利于我国城市发展战略的实施,也不利于推进城市地下空间资源合理开发利用
Case by the rational development and utilization of underground space resources for the sustainable development of our city is essential. Since the reform and opening up, a large number of large-scale underground space projects have been spawned in the urban construction of our country. However, the legislation on the exploitation and utilization of underground space resources in our country is still at an exploratory stage and is basically blank on the basis of civil legislation. Only “Property Law” 136 provisions are slightly involved, which is obviously not conducive to the implementation of China’s urban development strategy, is not conducive to promoting the rational development and utilization of urban underground space resources
