警务实践中的行政指导,应称为公安行政指导而非警察行政指导。公安行政指导的表现形式主要有警方提示,内保管理中的下达整改通知书、责令限期整改,交通管理中的口头警告,治安管理中的家暴告诫等制度,而治安调解、对特定对象具有拘束力的告知(警察教示)不属于行政指导的范畴。公安行政指导在学理上分为助成性公安行政指导和规制性公安行政指导,规制性行政指导属于行使法律正式规制权的前置阶段,是行政过程的重要组成部分。
Administrative guidance in the police practice should be called the administrative guidance of public security rather than the police administrative guidance. Public security administrative guidance is mainly manifested in the form of warnings from the police, issuance of rectification notices in internal protection administration, rectification within a prescribed time limit, verbal warnings in traffic management, and housekeeping warnings in public security administration. The guidance of public security administration is theoretically divided into help-oriented public security administrative guidance and public security administrative guidance. The guidance of regulatory administration belongs to the pre-stage of exercising formal legal power of law. It is an important part of the administrative process.
