犯下滔天罪行,战后本应定为甲级战犯,处以绞刑。1945年11月,中国共产党在延安公布的战犯名单中,根据冈村宁次所犯罪行,理所当然地将他列为侵华日军第一号战犯。但蒋介石、何应钦等人出于反共的需要,置国内外舆论于不顾,对冈村宁次竭力加以保护,将其从战犯名单上抹掉,还让他留在中国,待若上宾,甚至煞费苦心地寻找律师为其辩护,制造种种借口回避让冈村到东京远东国际法庭接受审判。冈村因而得以逃脱正义的惩罚,苟全了性命。他对蒋介石、何应钦的救命之思,自然是感激涕零,寻机以报。
