近日,北京市朝阳区法院公开审理并当庭宣判了一起劳动者因隐婚而遭用人单位辞退的劳动争议案件。被告张贺然系某公司商务拓展专员,在入职时隐瞒已婚事实,以未婚身份填写个人资料。之后,因怀孕向原告请假两周,并告知单位她已登记结婚。单位以其填写的个人资料与事实不符,违反诚信原则,也违反双方劳动合同和公司《员工手册》为由,与其解除了劳动合同。被告则主张,其隐瞒已婚事实
Recently, a court in Chaoyang District of Beijing publicly heard and adjudicated in court a labor dispute involving a worker who was dismissed by the employing unit for the sake of a hidden marriage. Defendant Zhang Heran is a company’s business development commissioner, hiding the fact of being married on entry, and filling in personal data as a single person. After that, he took a two-week leave of absence from the plaintiff because of pregnancy and told the unit that she had been registered for marriage. The unit dismissed the labor contract with the fact that the personal data filled in by it were inconsistent with the facts, violated the principle of good faith, and violated the labor contract of both parties and the “Employee Handbook” of the Company. The defendant argued that it concealed the fact of being married
