●与传统图书馆不同,数字图书馆依赖网络而生存,并将成为网络社会的重要成员。但在现有著作权体系下数字图书馆的开发将会举步艰难,首先在信息收集中涉及到大量著作权许可问题,在没有完善的著作权集体管理制度的情况下,获得许可及支付报酬都是非常严峻的现实;而数字图书馆的服务角色定位又决定在法定许可、合理使用方面有多大的受益;数字图书馆在开发后仍然面临如何进行自己的著作权保护与管理。●针对数字时代出现的著作权问题,作者分析数字图书馆面临的问题及国外的发展状况,提出了中国著作权保护应:(1)尽快完善我国的著作权集体管理制度;(2)适当放宽著作权合理使用的范围;(3)图书馆可以享受更多的法定许可。●中国数字图书馆工程启动在即,在遵守现有法律规范的情况下,亦应在推动著作权立法上作一些贡献。
● Unlike traditional libraries, digital libraries rely on the Internet for survival and will become important members of the online community. However, under the existing copyright system, the development of digital libraries will be difficult. First, a large number of copyright licensing issues are involved in information collection. In the absence of a sound collective copyright management system, licensing and payment are very serious The digital library’s role in service determines the extent to which statutory licensing and fair use can benefit. The digital library still faces protection and management of its copyright after its development. ● In view of the issue of copyright in the digital age, the author analyzes the problems faced by digital libraries and the development of foreign countries and proposes that the protection of copyright in China should: (1) improve China’s copyright collective management system as soon as possible; and (2) appropriately relax the rational use of copyright The scope of the library; (3) libraries can enjoy more statutory permission. ● As soon as the project of China Digital Libraries is started, compliance with the existing laws and regulations should also make some contributions to the promotion of Copyright Legislation.
