近年来旅游营业人违约给旅游者造成损害的问题日益突出。由此本文从精神损害范围角度出发,论述在旅游合同立法中应当规定违约责任精神损害赔偿制度,支持旅游者在旅游合同纠纷中关于精神损害赔偿的请求,不仅有利于旅游业的健康发展,而且符合法律追求公正的价值目标。
In recent years, the problem of damage caused by the breach of tourist operators to tourists has become increasingly prominent. Therefore, this article from the perspective of the scope of mental damage, discussing the system of compensation for mental damage which should stipulate the liability for breach of contract in the tourism contract legislation, and supporting the tourists’ requests for compensation for mental damages in the tourism contract disputes, not only conducive to the healthy development of tourism industry, In line with the law the pursuit of fair value goals.
