随着浙江张氏叔侄案、内蒙古呼格吉勒图案等报道迅速占据着各大新闻头版头条,一个四字组合词语-冤假错案对于我们已不再陌生。在司法实践中,切实纠防冤假错案的发生关系到刑事诉讼惩罚犯罪、保障人权的需要。控申部门作为检察机关发挥法律监督职能一线的业务部门在纠防冤假错案方面起着十分重要的作用,所以今天我选取了刑事错案产生原因、认定标准及纠正程序这一课题,意在与各位领导探讨交流一下在日常办理刑事申诉案件时如何能真正运用法治思维、法治方式解决纠防冤假错案难题、规范办案、维护公平正义。

In judicial practice, the effective prevention and punishment of unjust and false cases has a bearing on the need of criminal proceedings to punish crimes and safeguard human rights. As a procuratorial organ, the controlling departments play a supervisory role in the legal field. The front-line business units play an important role in rectifying unjust and false cases. Therefore, I chose the cause of the misclassification of criminal cases, the criteria for determining and the procedures for correcting procedures today, The leaders discussed how to truly apply the thinking of the rule of law and the rule of law to solve the difficult problems of correcting unjustly and wrongly wrong cases, standardizing handling of cases and safeguarding fairness and justice during daily handling of criminal complaint cases.
