传统知识的保护,是学术界和实务界普遍关注的热点问题。对于传统知识法律保护的模式,通常而言具有纳入知识产权制度保护、专门保护、纳入知识产权制度并对现有知识产权制度加以调整保护三种模式。通过对于传统知识与知识产权保护制度之间的异构性分析,立足经济学外部性理论进行分析,并结合所调整法律关系的探索,探讨传统知识保护专门制度构建的必要性。最后,研究传统知识专门法律制度的基本构成,探讨传统知识保护专门制度构建的可行性。
The protection of traditional knowledge is a hot issue commonly paid attention by academics and practitioners. The traditional model of legal protection of legal knowledge, usually with the protection of the intellectual property system, special protection, integration into the intellectual property system and the existing intellectual property system to adjust and protect the three models. Through the analysis of the heterogeneity between traditional knowledge and intellectual property protection system, based on the theory of economic externality, combined with the exploration of the adjusted legal relationship, the necessity of constructing the special system of traditional knowledge protection is discussed. Finally, the author studies the basic constitution of the specialized legal system of traditional knowledge and discusses the feasibility of constructing the special system of traditional knowledge protection.
