知识产权部门联合执法是我国知识产权行政保护发展的最新趋势,具有力量集中、查处迅速、对侵犯知识产权侵权违法犯罪行为打击严厉的优势,但也存在知识产权各执法部门推诿扯皮、浪费执法资源、执法信息不能共享等问题。借鉴美日韩知识产权联合执法的做法,提出了建立高级别权威性知识产权部门联合执法协调机构、建立专业高效知识产权部门联合执法队伍、建立畅通快捷知识产权执法信息共享机制等对策建议。
The joint enforcement of intellectual property departments is the latest trend of the development of administrative protection of intellectual property in our country. It has the advantage of centralized power, prompt investigation and punishment and severe crackdown on criminal activities of infringement on intellectual property infringement. However, there are also IPR law enforcement departments that prevaricate and waste law enforcement resources , Law enforcement information can not be shared and other issues. In the light of the practice of joint enforcement of intellectual property in the United States, Japan and South Korea, some countermeasures are put forward, such as establishing a co-ordinating body for law enforcement at a high level and authoritative intellectual property department, establishing a joint law enforcement team of professional and efficient intellectual property departments, and establishing an information sharing mechanism for smooth and quick IPR enforcement.
