民法是现代法治的基础,它蕴含着丰富的文化积淀及其人文气息。而民法理念是在人类历史发展过程中不断积淀起来的一种精神,是市民社会的一种价值追求。民法理念的本质是公平正义,它的核心是对于私权的尊重与保护、对于人格平等的追求以及私法自治理念的贯彻。民法理念随着社会经济的发展经历了一个由形式正义到实质正义的发展过程。对于我国民法理念的构建而言,要从与当前法治建设的角度出发,使其更为贴合我国社会经济发展的实际,从而更好的为社会经济服务。
Civil law is the foundation of modern rule of law, which contains a rich cultural heritage and its cultural atmosphere. However, the concept of civil law is a kind of spirit that has been accumulated in the course of development of human history and is a value pursuit of civil society. The essence of the concept of civil law is fairness and justice. Its core is the respect and protection of private rights, the pursuit of equality of personality and the implementation of the concept of self-government of private law. With the development of social economy, the concept of civil law has undergone a process of development from formal justice to substantive justice. For the construction of the concept of civil law in our country, we should proceed from the perspective of the current construction of the rule of law so as to make it fit the reality of our country’s social and economic development and better serve the society and economy.
