本文通过对比各种学说的优劣,得出应将破产管理人定位为信托关系中的受托人,并基础,提出构建我国破产管理人制度的具体构想。
By contrasting the pros and cons of various theories, this paper concludes that the bankruptcy administrator should be the trustee in the trust relationship and should be based on the concrete conception of constructing the bankruptcy administrator system in our country.
