在城管执法领域,在当下中国,行政执法者与被执法者之间的暴力冲突事件屡次发生,并且愈演愈烈。城管作为国家的一级行政机关,行使其职权的方式、方法备受关注与质疑。本文借由针对城管暴力执法现状的分析及对比例原则的解析,试分析城管暴力执法行为背后的合法性与合理性。
In the field of urban management law enforcement, the violent conflicts between the current law enforcement officials and the law enforcement officials in China are frequent and intensified. Urban management, as the first-class administrative organ in the country, has been attracting much attention and questioning the methods and methods of exercising its functions and powers.
