国际上有人认为:“人权高于主权”,不干涉内政原则不适用于人权问题,“人权无国界”……这些论调的背后,除了意识形态原因作祟外,还有理论上混淆了国外主权与国内主权、人权的国内保障与人权的国际保护等一系列概念,模糊了人权与主权的质的关系。因此,理论上澄清是非,实践中作出回答,在当前尤显必要。本文试图从人权与主权的互动性
Some people in the world think: “Human rights are higher than sovereignty.” The principle of non-interference in internal affairs is not applicable to human rights issues. “Human rights have no boundaries.” Behind these arguments, apart from ideological reasons, there is also a theoretical confusion between foreign sovereignty and Domestic sovereignty, domestic protection of human rights and international protection of human rights and a series of concepts that blurred the relationship between human rights and sovereignty.
