新颁布的《北京市园林绿化行政处罚裁量基准》,对市民擅自在湿地保护范围内投放外来物种行为的行政处罚,根据湿地等级及危害程度细分为6个等级,由此引发了人们对放生与湿地保护的辩证讨论与深入思考。《北京市湿地保护条例》第31条对“放生”行为予以行政处罚的要件为未经批准、外来物种、湿地保护范围内。“放生”行为同时满足上述3个条件即将受到行政处罚。首先,大部分放生行为均属于“未经批准”范畴。我国现行法律法规对放生行为缺乏批准主体、程序及范围的明确规定,故严格来讲,凡是未经相关部门论证或批准的“放生”行为均属“擅自”。
The newly promulgated “Benchmark Discretionary Standard for Administrative Punishment of Landscaping in Beijing” imposes administrative punishments on the unauthorized use of alien species by the public within the scope of wetland protection. It is subdivided into six levels according to the grade of the wetland and its degree of harm, Dialectical discussion and deep reflection on wetland protection. Article 31 of the “Regulations of Beijing Municipality on the Protection of Wetlands” imposes administrative penalties on “letting go” acts as unapproved, alien species and wetland protection. “Release ” behavior while meeting the above three conditions will be subject to administrative penalties. First of all, most of the release acts fall under the category of “unauthorized”. The existing laws and regulations in our country lacks the explicit stipulations on the subject, procedure and scope of the approval of the act of release, so strictly speaking, all behaviors that are not justified or approved by relevant departments belong to “unauthorized”.
