据近期的《民主与法制》杂志披露,河南沁阳市的地方政府为了吸引外来客商,使出了“超国民待遇”的特殊手段,在招商引资的过程中,赋予外来客商种种特权,譬如交通违章不予处罚、在娱乐消费场所不接受公安机关检查等等。更为严重的是,这类透支政府信誉、私相授受行政权力的现象,在不少地方都不同程度地存在着(编者注:相关报道详见本刊2007年第4期)。从表面上看,一些地方政府为了招商引资而赋予外来客商特权,是一种违反法律的行为,但是通过比较中外市场经济发展的不同历史背景,我们不难发现更为深层的原因。
According to the recent “Democracy and Law” magazine, a local government in Qinyang City of Henan Province, in order to attract foreign merchants, has resorted to special measures such as “super-national treatment”. On the surface, some local governments give foreign merchants preferential treatment for attracting foreign investment. This is a violation of the law. However, it is not hard to find a deeper reason for comparing the different historical backgrounds of the market economy in China and other countries.
