近年来,集体土地,尤其是耕地流失严重。土地面积的缩水主要源自农用地向建设用地的转化,既包括农用地向集体经济组织以外的单位和个人的建设用地转化;也包括集体经济组织内部农用地的转化,主要指宅基地。学界往往只注重对前一方面问题的研究,而忽略后一方面的问题。但在实践中,后一个问题对集体土地造成的损害可能更甚。本文将结合我国法律的相关规定,分别对这方面存在的问题进行分析,提出完善集体所有土地制度的建议。
In recent years, the loss of collective land, especially cultivated land, has been serious. The shrinkage of land area is mainly due to the conversion of agricultural land to construction land, including the conversion of agricultural land to construction land of units and individuals other than collective economic organizations, and the conversion of agricultural land within collective economic organizations, mainly referring to land sites. Scholars often focus only on the study of the previous problem, while ignoring the latter problem. However, in practice, the latter problem may cause more damage to collective land. Based on the relevant provisions of the law of our country, this article separately analyzes the existing problems in this respect and puts forward suggestions on how to improve the system of collectively-owned land.
