没有无源之水,没有无本之木。人类社会中的一切现象都有其可以追溯的源头。当我们猜测原始的氏族社会就应当存在某种意义上的“政府”时,我们也可以在同样的意义上猜测,在氏族社会中也存在着法和宪法;宪法和政府、国家是在同一次序上孕育并在同一次序上诞生的。
