欧盟对军民两用产品的出口控制已经被纳入欧盟的共同商业政策领域,属于欧盟的专有权能范畴,但也仅仅是部分地统一到欧盟层面,成员国仍保留很大的自由裁量权力。面对新的国际形势,欧盟着手对该制度进行改革,一方面欧盟既要对这类产品实施统一的控制,另一方面又不能因为控制而阻碍这类产品参与国际竞争,需要在这两方面进行平衡。这实际上是欧盟的对外贸易政策与安全政策的一次“碰撞”。我国应抓住欧盟两用产品出口控制制度的特点与目前欧盟加紧着手立法改革的契机,争取其放松对华高技术产品出口的限制,使其尽快解除对华军售禁令。
The EU’s export control of dual-use products has been incorporated into the common commercial policy of the EU. It belongs to the EU’s exclusive sphere of competence. In the face of the new international situation, the EU embarks on the reform of the system. On the one hand, the EU needs to exercise unified control over such products while on the other hand it must not impede the participation of such products in international competition because of its control. Balance. This is actually a “collision” of the EU’s foreign trade policy and security policy. China should grasp the characteristics of EU dual-use product export control system and the current opportunity for the EU to step up its legislative reform. China should relax its restrictions on the export of high-tech products to China and lift its ban on arms sales to China as soon as possible.
