中国和日本同属东方亚洲国家,但是在亚非拉众多国家中,日本法律文化的近代化是最为成功的,明治维新以前,日本法承袭中国唐代和明代法制的传统,是中华法系的重要成员。明治维新以后,日本在向欧洲学习的过程中,以法德等大陆法系国家的法律为模式,迅速走上了法制近代化的道路。第二次世界大战以后,日本又吸收了英美法系的许多成果,从而使其法律体系更加系统和完备。本文从日本法制改革的历程及其原因来阐明它对中国法制改革的启示。
Both China and Japan belong to the Asian countries of the East, but among the many countries in Asia, Africa and Africa, the modernization of the Japanese legal culture is the most successful. Before the Meiji Reform, the Japanese law inherited the traditions of the Tang and Ming Dynasties in China and was an important part of the Chinese legal system member. After the Meiji Restoration, in the process of learning from Europe, Japan took the law of countries like France and Germany as the model and quickly embarked on the path of the modernization of the legal system. After World War II, Japan absorbed many achievements of the Anglo-American legal system, thus making its legal system more systematic and complete. This essay illustrates its enlightenment to the legal reform in China from the course of the legal reform in Japan and its reasons.
