《最高人民法院关于审理城镇房屋租赁合同纠纷案件具体应用法律若干问题的解释》第24条第2项规定的内容确立了对近亲属购买房屋的优先保护,其法理基础在于在一定范围内维护近亲属基于其身份的财产权以及维护社会和谐。对于近亲属的此种优先保护并不是近亲属的优先购买权,而是出租人出卖租赁房屋的一种特别方式,其性质以及在司法实践中的适用不能同优先购买权一概而论。
