人民检察院作为公诉机关,是以国家的名义向人民法院指控特定的犯罪,请求人民法院审理并对被告人判处刑罚。提起公诉的证明标准是指作为控方的检察机关运用证据证明被告人犯有某种罪行,要求其承担刑事责任并据以交付人民法院审判所应达到的程度,即检察机关运用证据证明到何种程度方可将案件提交法院审判。在这里,笔者仅就检察机关提起公诉的证明标准及相关问题,浅谈几点认识和建议。
