国际货物买卖中的公法标准问题指的是在国际货物买卖中,由于货物要跨越国境,标的物应符合哪个国家关于产品质量、劳工保护以及环境保护等方面的公法的要求问题。但不同的国家在政治、文化、经济等方面的发展水平不同,各国对同一产品的公法标准也各不相同,本文就是以影响国际货物买卖中的公法标准问题的两个代表案例为例,并结合有影响力的学者对公约的评述,论述公约在这一问题上的态度和各国实践中的发展。
The problem of public law in the international sale of goods refers to the question of which country should meet the requirements of the public law in the aspects of product quality, labor protection and environmental protection in the international sale of goods because the goods cross the border. However, different countries have different levels of development in political, cultural and economic fields, and different countries have different public law standards for the same product. This article takes two representative cases that affect the standard of public law in the international sale of goods as an example. Combined with influential scholars comment on the convention, discusses the convention’s attitude on this issue and the development in the practice of each country.
