《劳动合同法》的实施已逾两年。两年来,全国的劳动纠纷案件数量呈现井喷式爆发,而且绝大部分是由劳动者一方提起仲裁或诉讼的。据劳动保障部门提供数据,2009年全国劳动争议案件近100万件。要最大限度地依法保障劳动者的合法权益,除国家政府部门要进一步完善法律制度、加大执法监督,工会组织发挥依法维护职工合法权益的作用之外,重要的途径是使劳动者增强自身的法律意识,了解、掌握相关的劳动法律知识,清楚地了解自己应享有的权利和应承担的义务,以及用人单位侵犯劳动者合法权益后应承担的法律责任、如何处理劳动争议等内容;使自己的权利不受或少受侵害,在合法权益受到侵害时,用法律武器正确维护自己的合法权益。
