证券投资者保护制度在世界许多国家已有成功经验,我国根据新证券法也已成立了证券投资者保护基金有限责任公司,从而完善了投资者保护立法。然而由于缺乏该基金具体赔偿制度,使立法并不具操作性。具体赔偿制度应该包括赔偿范围、赔偿对象、赔偿数额和赔偿程序等,本文就赔偿范围作出初步的探讨与完善建议。
The securities investor protection system has been successfully used in many countries in the world. According to the new securities law, China Securities Regulatory Commission has also established a securities investor protection fund limited liability company, thus improving the investor protection legislation. However, due to the lack of a specific compensation system for the fund, the legislation is not practical.
