历史性权利是为弥补时效在国际法理论上的不足而产生的一个理论概念。它是一系列国家主权行为长期累积作用的结果,体现了占领领土历史性与法律性的结合,历史性巩固是国家取得领土历史性权利的法律程序。历史性权利克服了与国家领土取得方式传统分类相关的一系列棘手问题,它不仅适用于海洋争议领土,也适用于陆地争议领土。历史性权利已经成为国际领土争端司法裁判的理论依据。
Historical rights are a theoretical concept that is made to make up for the deficiency of the limitation of international law in the theory of international law. It is the result of a series of long-term and cumulative effects of a series of sovereign acts of the state that reflect the historic and legal combination of the occupied territories. Historical consolidation is the legal process by which the State acquires historic rights over the territory. Historical rights have overcome a series of thorny issues related to the traditional classification of national territorial access that apply not only to maritime disputed territory but also to territorially contested territories. Historical rights have become the theoretical basis of judicial adjudication of international territorial disputes.
