自古以来,中国就是一个法律社会,法律一直是我们坚实的后盾。新中国成立以来,虽然我国的法律逐渐完善,但由于受到阶级斗争的长期以来的影响,国家的职能已经被定位成了对敌人的专政,而法院的审判就成为了专政对付敌人最有力的武器。由于改革开放政策的大力实行,致使中国的社会发展也开始转型。在此过程中,为了满足市场经济和依法治国等各方面的需要,我国法院的审判面临着很多严峻的问题。

Since the founding of new China, although the laws of our country have been gradually perfected, the functions of the state have been positioned as the dictatorship of the enemy due to the longstanding influence of the class struggle, and the trial of the court has become the most powerful weapon of the dictatorship against the enemy . Due to the vigorous implementation of the policy of reform and opening up, China’s social development has also begun to change. In this process, in order to meet the needs of market economy and governing the country according to law, the trial of our country’s courts faces many serious problems.
