从本质上说,证人证言真实性的保障制度属于民事诉讼法领域。诚实信用原则以及社会实践需要确立、完善证人证言真实性的保障制度,而证人证言真实性的保障制度的确立与完善有助于诉讼公正、效益价值的实现、证人制度的完善。为了实现公正、提高效益、遏制伪证,我国应确立证人宣誓制度,引入和改造交叉询问制度,完善证人伪证处罚制度。
In essence, the system of safeguarding the authenticity of witness testimony belongs to the field of civil procedural law. The principle of honesty and credit and social practice need to establish and improve the system of guaranteeing the authenticity of witness testimony, and the establishment and improvement of the guarantee system of the testimony of witness testimony contribute to the fairness of litigation, the realization of benefit value and the improvement of witness system. In order to achieve justice, improve efficiency and curb perjury, our country should establish a system of oath of witness, introduce and reform a system of interrogation, and perfect the punishment system of witnesses perjury.
