保障人权是贯彻以人为本的重要手段。而国际劳动标准亦与保障人权具有一致的精神内涵。本文指出在国际劳工标准成为贸易乃至国际交流的共同语言大背景下,我国劳动法应采取相应的对策:规定一定条件下的罢工权;应明确规定不得强迫劳动;建立统一的国内就业市场,杜绝或减轻劳动力市场上的就业歧视。
Protection of human rights is an important means of implementing people-oriented principle. International labor standards also have the same spirit as human rights protection. This article points out that under the background that international labor standards become the common language of trade and even international exchange, the labor law of our country should take the corresponding countermeasures: to stipulate the right to strike under certain conditions; to make it clear that forced labor should not be imposed; to establish a unified domestic employment market, Or alleviate employment discrimination in the labor market.
