公安民警人性化执法是针对我国目前公安执法过程中存在的突出问题而提出的。在构建社会主义和谐社会的大背景下,迫切需要民警人性化执法协调和改进警民关系。公安民警人性化执法,是指在执法过程中,依法保障当事人合法权益的前提下,依照法定的职权和法定的程序,转变执法理念和执法方式,以人为本,实现执法公正的一项专门活动。民警在人性化执法过程中要防止走入“放弃严格执法”、“软弱执法”和“人情化执法”的误区。本文拟从完善公安法律制度、提高公安民警综合素质、树立三种新执法观念、强化执法监督、提高全社会法律意识水平五个方面入手,对实现公安民警人性化执法做出构想。
The humane enforcement of public security police is based on the prominent problems that exist in the current law enforcement of public security in our country. Under the background of building a harmonious socialist society, it is urgent to humanely coordinate law enforcement and improve the relationship between the people and police. The humane enforcement of public security police refers to a special activity of law enforcement justice and enforcement based on the principle of lawful authority and statutory procedures and people-oriented law enforcement under the precondition of lawful protection of the legitimate rights and interests of the parties involved in law enforcement. In the course of humane law enforcement, the police should prevent the misunderstanding of “abandoning strict law enforcement”, “weak law enforcement” and “humane enforcement”. This article intends to improve public security police law enforcement system, improve the overall quality of public security police, establish three new concepts of law enforcement, strengthen the supervision of law enforcement and improve the level of legal awareness of the whole society to start, to achieve the realization of public security police human law enforcement ideas.
