我们要获得对某一法律规范的理性认识,那么必须通过相应的学术手段和一系列的研究方法,从法理的高度来辨析这一部门法的概念及特征。本文旨在探析环境法的本质属性与特征,把握其调整对象的特殊性,这也是科学的建立环境法体系的需要。本文亦会对环境权利体系配置展开一定的讨论。
If we want to gain a rational understanding of a certain law and regulation, we must differentiate the concept and characteristics of the law of the sector from the perspective of jurisprudence through corresponding academic means and a series of research methods. The purpose of this paper is to probe into the essential attributes and characteristics of environmental law and to grasp the particularity of its object of adjustment. This is also the need of establishing an environmental law system scientifically. This article also discusses the configuration of environmental rights system.
